Skip terms and conditions
SKIP LICENCE TERMS AND CONDITIONS
The following conditions shall be deemed terms of the licence. The licensee agrees to comply with the schedule of conditions as contained as follows failure to do so may result in the revoking of the permission granted.
Section 139 Of The Highways Act and Section 65 Of The Road Traffic Regulation Act
Licence Conditions:
1. Each skip shall be designated in the licensed position and shall be placed so that its longest sides are parallel to the edge of the carriageway and as near to the edge of the carriageway as is reasonably practicable, and so that it does not impede the surface water drainage of the highway nor obstruct access to any manhole or the apparatus of any Undertaker as defined by the New Roads and Street Works Act 1991 or the East Sussex County Council.
2. Where more than one skip is on the highway at any one time, the skips shall be positioned as close as possible to each other but not as to obstruct access to any premises unless the consent of the occupier of those premises has been obtained.
3. Each skip shall not exceed 5 meters in length by 2 metres in width.
4. Each skip or group of skips shall while on the highway, be marked (guarded) and lit in accordance with the following requirements:
a) The ends of each skip (that is to say, the sides of the skip facing traffic in both directions when the skip is positioned as mentioned in conditions 1 above) shall be painted yellow and there shall be attached markings which will comply with those prescribed in the Builders’ Skips (Markings) Regulations 1984. The painting and prescribed markings at all times should be kept clean and efficient and clearly visible for a reasonable distance to persons using the highway.
b) Each skip shall be guarded when required.
c) Each skip must be properly lighted during the hours of darkness. Any lamps shall comply with BS EN 12352-2006 Traffic Control Equipment
5. No skip, when standing on the highway, shall contain any (inflammable) explosive, noxious or dangerous material or any material which is likely to putrefy or which otherwise is, or is likely to become, a nuisance to users of the highway.
6. No skip shall be used in such a way that any of its contents fall onto the highway, or that there is an escape of dust from the contents of the skip when standing on the highway.
7. Each skip shall be removed for emptying as soon as practicable, and in any case not later than 2 working days after it has been filled.
8. No skip shall remain on the highway after the expiry date of the issued licence.
9. All materials placed in each skip shall be properly disposed of and the highway where the skip or skips have been deposited shall be left in a clean and tidy condition during and on the expiry of this licence.
10. The Licensee shall permit access to any Undertaker as defined by the New Roads and Street Works Act 1991 and shall if required remove the skip or skips as necessary to provide such access including but not limited to highway maintenance activities.
11. Any damage caused to the highway from the act of delivering, placing, or removing any container or skip may be repaired by the Licensor and the Licensee must indemnify the Licensor on demand against any costs incurred by the Licensor in connection with such repairs in this instance. Alternatively the licensee may be responsible for making good to the satisfaction of East Sussex Highways, the appropriate licence or permissions may be required to do so.
12.The Licensee must indemnify the Licensor against all claims for legal liability arising from the issue of this Licence and provide, for the duration of the Licence, Public Liability Insurance cover of not less than Ten Million Pounds. Documentary proof of the holding of this cover must be provided on demand.
13. The skip owner’s 24-hour telephone contact number must be visible.
14. East Sussex Highways reserves the right to alter, add special conditions or cancel this licence at any time with reasonable cause. Should this licence be cancelled at any time, the licence fees will still apply.
15. No skip or container is to be placed in a parking bay until the appropriate parking bay suspension has been obtained.
