The Legal Position – Section 169 Highways Act 1980
- This legislation provides penalties by way of fines through the Court in the event of non-compliance with licence conditions
- The applicant can appeal to the Magistrate’s Court in the event of refusal to grant a licence or about the imposition of a special condition.
- The Highways Act 1980 provides the Highway Authority powers to arrange removal of unauthorised structures from the highway and to recover all reasonable costs incurred.
